Alles, alles Les Bleus! (legal case against one of the EU leaders)

From the French initiative www.29mai.eu we have received following appeal:

Dear Sirs,

the new Treaty, identical to the treaty it replaces to establish an European Constitution, was adopted in December at the summit in Lisbon. The French President announced that he would not give the French another Referendum.
In the United Kingdom, although Tony Blair promised a Referendum, Gordon Brown has also refused to hold one.
There does exist a legal way to stop the ratification, by collectively taking the case to The European Court of Human Rights.
This is the idea of two French Nationals (a Lawyer and an IT specialist) who voted No in the French Referendum on 29th of May 2005 when the outcome of the vote was No.
The case against the decision of the French President not to organize a further Referendum must be placed before the Court of Human Rights by 4th of February. The grounds for the case are violations of the right of the people to free elections which is guaranteed in Article 3 Protocol 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms. In France as in all EU countries the European Court of Human Rights is recognized and if it is not respected the Court would be able to overturn any adverse decisions.
